Terms of Service

Welcome to KENKO! These Terms of Service ("Terms") govern your use of the KENKO mobile application (the "App") operated by KENKO ("we", "us", or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • One person may not maintain more than one account

4. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Upload malicious content or code
  • Impersonate another person or entity
  • Use the App to harass, abuse, or harm others

5. Health Disclaimer

KENKO is not a medical device and does not provide medical advice.

  • The breathing exercises and workout tracking features are for general wellness purposes only
  • Consult a healthcare professional before starting any exercise or breathing program
  • If you experience discomfort, dizziness, or any adverse effects, stop immediately and seek medical attention
  • We are not responsible for any injuries or health issues that may arise from using the App

6. Intellectual Property

  • The App and its original content, features, and functionality are owned by KENKO
  • You may not copy, modify, distribute, sell, or lease any part of the App
  • Our trademarks and trade dress may not be used without prior written permission

7. User Content

  • You retain ownership of content you create (workout logs, journal entries, voice recordings)
  • By using the App, you grant us a limited license to store and display your content to provide the service
  • You are responsible for the content you create and upload

8. Termination

We may terminate or suspend your account at any time, without prior notice, for:

  • Violation of these Terms
  • Conduct that we believe is harmful to other users or our business
  • Any other reason at our sole discretion

You may delete your account at any time through the App settings.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KENKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. Indemnification

You agree to indemnify and hold harmless KENKO and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the new Terms in the App
  • Sending you an email notification

Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by applicable laws, without regard to conflict of law principles.
